Association has and is willing to settle this matter from the beginning, however the Defendants have chosen not to, which has escalated the legal services costs.
0ur Rule 408 Waived Settlement Offer dated November 7, 2019, this offer was made by the BOD seventy (70) days or 2 months and 9 days after filing our Complaint on Aug. 29, 2019. This offer was rejected by the Defendants (Beaver Land, LLC; Beaver Valley Water Company, Inc.; and Mr. Armstead) through their counsel on December 20, 2019.
On January 8, 2020, we began discussions with Defendants counsel regarding mediation. Defendants finally agreed to a mediation dated on June 3, 2020
On September 11, 2020, Defendants’ new counsel advised that they would not participate in mediation and wanted to go to trial. On November 4, 2020, we re-submitted our November 7, 2019 Settlement Offer (after the first order granting in part our First Motion to Dismiss) again Defendants’ declined the offer.
